For many years, our solid legal guidance to physicians about what they could do to benefit their patients without running afoul of the fraud and abuse laws has been restrictive. Our advice reflected the state of the law until the new safe harbors under the anti-kickback statute and regulatory exceptions to the civil money penalties were published, allowing physicians (and others, but we are focusing, as we usually do, on physicians) to give beneficiaries specified items and services of value.
